Terms of use

These terms apply to the Fiorentino Global website, published workspace, and home-screen app. Entering a site code, signing in, or continuing after a notice means you accept this version.

1. Parties and access

The operator of this product is Fiorentino Global. The customer is the organisation that holds the operator or company account. You are a person using a site code or login issued by that customer.

Access is by invitation only. A site code is a key, not a public registration. If you do not have a current code, you must not use the workspace.

The customer decides who may enter, which sites they see, and which modules they can open. Super users may view a company as that user to support them. That is not a right to copy another customer’s records.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the software for that customer’s project, safety, operations, and related office work.

You must not copy, rent, scrape, reverse engineer, or resell the product, or use it to build a competing service. You may print or export your own job records.

3. Your records and HSE use

You and the customer own the job data you enter: reports, photos, registers, rosters, plant hours, incidents, and company files.

You must only enter information you are allowed to hold for work. That includes photos of people, medical or incident detail, licences, and another company’s documents.

Daily reports, Take 5s, JHAs, SWMS, uploaded company or contractor policies, critical-control checks, journey plans, and similar forms are operational aids. They do not replace a competent person, a ticketed operator, a licensed supervisor, or advice from a lawyer or safety professional. If a record and the site disagree, the live site wins.

4. Acceptable use

Do not upload malware, offensive material, or files you do not have the right to keep.

Do not try to open another company’s isolated data, share a site code in a public channel, or impersonate someone else.

Do not use the messaging, camera, or meeting tools to harass anyone or to record people who have not been told they are on a work record.

We may lock a code, a device, or a session if use looks abusive, unsafe, or unlawful.

5. Service, backups, and change

Trial hosts and early published hosts are provided as-is. We aim for continuity but do not promise a particular uptime.

Browser sessions can lose data if the tab is closed or storage is full. The customer must export backups of reports and attachments they need to keep.

We may add, change, or retire features. A new date and version on this page means the terms have changed. Keep using the product after that date means you accept the new version, unless the customer ends the account.

6. Liability

Nothing in these terms excludes rights you cannot contract out of under the Australian Consumer Law.

Otherwise the software is provided without warranties of uninterrupted access or fitness for a particular job.

To the extent allowed by law we are not liable for site incidents, failed journeys, late work, lost profit, or decisions made on incomplete, offline, or outdated records. Those remain with the people running the work and the customer.

If we are liable despite that, our aggregate liability for a claim is limited to resupply of the service or the fees paid for the service in the three months before the claim, whichever we choose.

7. Ending access

The customer may revoke a code at any time. You must stop using the workspace when your job or contract ends, or when asked.

We may end or suspend the service for unpaid accounts, misuse, or if we withdraw the product. Export what you need before access ends.

8. Law

These terms are governed by the laws of Western Australia, Australia. Courts of that place have exclusive jurisdiction, except for any right you have to use a small-claims or consumer forum that cannot be excluded.
